Has anyone who's ever purchased a brand new iRiver (an H320 in this case) ever actually received a new one? I've been sent a refurbished one twice now. Needless to say I am neither impressed nor pleased. (Epsecially with the amount of time that ground shipping takes.)

Yes, I hit the "buy now" button for a brand new factory sealed 1 year warranty H320 and received a refurbished one (in an OG bog)with a defective plug. I sent it back and now they've sent me another refurbished unit (this time in an unmarked box labeled "refurbished"). I'm looking forward to hearing what they have to say for themselved tomorrow.

I've heard of emilyandlily, but decided not to buy anything from them (not that I would have anyway because I wouldn't buy something expensive internationally) because, even though they have a lot of feedback, 660 members leaving negative feedback is still far too many for me to want to do business with them.

I hope you get it resolved.

My "factory sealed" one came today- obviously not new or sealed. Wish I'd read this a few weeks ago and bought from someone else.

i bought my h10 brand new off them. it was brand new, i hope. and ive succesfully returned it to iriver rfor repairs, cos i broke my h10, but didnt tell iriver that

Could you post the results of your contact? I don't have a phone number and have gotten no response from emails. I guess the next step for me is a negative rating- they respond to those.

Id make a complaint to ebay first, they have been good in getting results, the suspend and ask questions later in my experience, it would be nice to stick it to them but your priority is to get you money back first.

yeh, maybe a complaint or two. because, IMO, two refurbs when u bought a brand new is quite shocking. did u have to pay for shipping etc on them both when sending it back?

OK, spoke to them this morning. Their # is 412-621-1180. They gave me some line about difficulties that they're have with a new warehouse in New Jersey, blah, blah, blah. They gave me the same story as last time: send it in we'll give you a $12 paypal credit for shipping and ship the correct item upon receipt of the returned item. I told them that this was unacceptable. I explained that I originally ordered the item on March 20 and that assuming they got it correct this time, I wouldn't get what I wanted until sometime around April 26th. The most they would budge would be to ship it back 3 day air - once they received the return. Since they're the only ones that sell this item brand new with a full warranty (assuming that they actually do), they have me by the short and curlies. So off I go to ship it back.

Could you let me know how you know you got a refurbished one? And how the boxes are "sealed by the factory"? Mine appears to be a return. It clearly was opened before as were the contents but I don't know how to tell if it's a refurb or "new". emilyandlily did respond to an email entitled "no response = bad rating" after multiple other email attempts. They don't understand how my box could be anything but brand new as shipped from iriver but I can exchange it for another new one.

If anyone has gotten an actual new one from them, what was the container and packing like?
And if you've gotten a refurb, how can you tell that from the packaging?

I'm somewhat wary about returning mine, even if used, given the 2 refurbs of the thread starter.

If anyone can give me more information I would really appreciate it.

i got my h10 brand new from them. it was in the h10 box, cant remember if it had plastic seal around it, but everything looked new and smelt new.

Danshe, the first one I received came in an original box with all of what was obviously the original packaging (all in excellent shape). Nothing was sealed. My first clue that it wasn't brand new new was that the unit itself did not have that little sheet of plastic protecting the display like so many people selling used ones boast about. My second clue was that the ac plug was not neatly coiled up - merely stuffed into the box. My third clue was that the female end of the plug that inserts into the device had a male prong from some other unlucky H320 lodged in it so tight that I had to use pliers to get it out. The final proof however was the warranty card - it was for 90 days and specified that this was a refurbished unit. While I was impressed with the outward appearance of the device it wasn't what I paid for so I sent it back.

The one I received on Monday came in a compact no-frills white box with "Refurbished" labeled underneath the item's title. The packaging is eaqually sparse. Use the phone # above to call in your concerns. You won't get anywhere with e-mails. I know that if I ask them directly if they actually have any brand new ones that they'll say 'yes'. I'm equally sure that they don't actually sell brand new ones as advertised, so I'm struggling too with what to do. The one that I currently have seems to be in excellent shape. So I guess its a principle thing. But what it I send it back and get another refurbed unit thats not as nice. I've lost close to 3 weeks of use and I've got a worse unit. Where's the win in that? What to do...

I've just found that mp3outlet is selling brand new units that appear (by looking line by line through their feedback) that they actually sell new units! and they're here in northern CA. I'm sending my emilyandlily unit back and getting a refund.

I'll let y'all know how it works out.

Thanks. I'm going to fill mine and if the hd is ok I guess I'll keep it rather than getting something worse. I'd love to return it and buy from mp3outlet. They have 100% positive feedback rating and they clearly mark refurb from new. But emilyandlily don't have option for me to return and get refund.

Mine was brand new from Emilyand Lilly

Maybe I was lucky. My H120 arrived brand new. If anything less than new, I would call them up and return it.

I'm going to return mine after all. I was thinking of keeping it even though it's not as described but my biggest concern about a used one is the battery. I loaded files into the player yesterday and discovered that fully charged, battery life is about 3 hours. I know players rarely live up to advertised times but 3 vs 15 hours is a major difference.
