I just found this thread... I bought a refurbished one unknowingly, and it still had holiday photos on it from the previous owner! If you 'DO' ever have to take your iriver back to be replaced, make sure you delete anything you want to keep private!! I returned the player for another, only to have the same thing happen AGAIN! Third time round I got a clean one, thank goodness!

Greetings everyone...
I too made the mistake of buying from emilyandlily. My wife purchased an iRiver h320, refurbished to new in box with warranty, manual, yada yada yada... The item came just before Christmas, without the original box, but a brown cardboard job with bubble wrapping around the player. There was no manual or warranty card, and the installation cd was broken and scratched. The item itself looked clean, no marks, no scratches - a USBTOGO mini USB -'A' cable came with it....strange, but I guess mistakes come in sending some things refurbished. I even smelled the ports - just like the link said, it was clean, sweet, faintly orange scent. But the issue was that it didn't come in a box, no warranty card, broken cd. I emailed them and called them during the holidays - it took a week to get a response. I hadn't filled up more than a few dozen files onto the unit until I could get the manual and really figure out how to operate this beautiful piece of machine. When I got a response, the woman who spoke with me was pleasant, knowledgeable and able to help me immediately. Four days later I had my manual and install CD, but no warranty card. I began to fill my unit up and there it hit me...I started getting a cyclic redundancy check error. I searched on the misticriver boards for similar stories and looked for fixes...followed the examples - and there it was - a bad hard drive. No two ways around it...I could get no more than 1 meg of data on my pretty, much sought after, dreamed of mp3 ipodkiller. I contacted emilyandlily immediately and left emails as well as phone messages. They responded VERY fast to the email I left them through ebay. I called an got a nice lady on the phone who didn't have a clue about players and products - but she apparently could ask her tech support from the office. They sent back an email detailing the same fix attempt I found here on misticriver. Word for word same - so someone owes someone a copyright fee. I called them back - took two times to get a real person, and lo and behold - I got the same nice lady. She them put me on hold to speak with her Return Department, and they offered me a full buyers refund. My question to them was - what about this warranty that you have listed on the e-bay website? "We are just offering refunds as there have been nothing but issues with this particular unit." "But" I said, "I want the unit, and I want you to fix it for me - as per your warranty..." "Well" the nice lady replied, "Just th is one time - we'll do a return and replace it with a newly refurbished unit from iRiver". I asked her if it would be in the box, with the warranty and manual, and be a US version, flashed to 1.o4 - she said yes, as they get them from iRiver. So here is my sad but true tale of woe. I am trying to decide what to do now that I have read this thread. I need a little guidance and mental assistance MisticRiverites...sh ould I trust them, take the chance on getting another broken model, or take the refund and hope to find another h320? Thoughts - please? |

To follow up on my last post -
I bit the bullet and took great faith in the old adage "lightning doesn't strike twice". I sent my i-Pod killer back to emilyandlily for a replacement. I am taking them on their word that they will replace the unit with a factory refurbished h320 and they are agreeing to test it to my specs before they deliver it. All in all, I've had several e-mails back and forth to them...the person replying seems to have had English as a third language. Phone calls however have been to very pleasant people - attentive, and of late, knowledgeable about the products they are (re)selling. I was told today (2/12) that they should have my new(er) h320 from iRiver ready to be shipped to me by the end of the week. After reading the boards, I have quite honestly been worried about emilyandlily. However, I am pleased with the customer service so far. I'll let everyone know what happens when the item is shipped and after it is received! |

All right - I really should have had my head examined for dealing with emilyandlily again... The long and the short of it is that I sent my h320 back to them for repair, and they said that a replacement was available and would be sent out to me ASAP.
HA! Again - HA! 4 days after the UPS return date passed (I was tracking the progress as UPS generates a ticket for you automatically) I contacted emilyandlily by phone and asked the inevitable "What the FRAK is going on? Where is my h320?" I was told that there had been an accident in the warehouse and my replacement was damaged. Several other units destroyed as well. The only recourse was an ebay buyer's refund - so I told them to process it and give me back my money. The people I spoke with were very polite, very friendly and very insistent on not replacing the item. So I did get my refund in less than 12 hours from my last phone conversation - but no DAP. Searching ebay, I found a private seller offering a tested h320, under 6 mos old, in original box, with an extra docking cradle and lcd remote for just $20 more than what I paid for from emilyandlily. Won the auction, had the item shipped to me in 3 days, and it came yesterday. It has a small scratch on one corner where the flip cover case doesn't cover the bottom corners, but other than that small cosmetic issue - it is GREAT!! Would I say that emilyandlily had pleasant customer service representatives - yes, without hesitation. Would I ever buy from them again? I am awaiting the weather reports from Tarteus, Gehenna and Hades to see if the hard freeze warnings are being issued. |

Yep - got out with a better deal all in all. Thanks for the encouragement jumbuck - I was really afraid I wasn't going to be an iRiver user. I was actually looking at iAudio (but thankfully not an iPod ::Shudder::

Problems with emilyandlilly
A partner suffered a similar fate with emilyandlilly. There was nothing he could do to stop a Nuvi from being shipped to a summer home where it was left in the snow and rain. After paying someone to search for it and ship it on to him it finally arrived almost two weeks later (I paid for expedited shipping and had him order it because I dont have a Paypal or eBay account) and was soaked. I am presently trying to dry the unit out and hope that it will turn on when it drys out. EBay can and should do something about these unethical people. My partner has a hundred percent feedback and has never had this much problem with a transaction. These people wont communicate. I saw somewhere that there was a class action lawsuit being prepared. Has anyone knowledge of that? I would like to help put them out of business.

Hows that for keeping up with paperwork?) that made me decide to place a negative rating on my transaction. They did not want to address my prior concerns yet it only took them less than 1 hour to call me personally in regards to their negative feedback that I left. I spoke with a young Asian man who offered to refund my shipping costs to withdraw my negative comment, which I refused to do. I stated to him that I would be most happy to be refunded my shipping, but that was not going to change my opinion regarding their company one bit and I would not withdraw my rating. He tried to explain to me that my comment would remain and be viewable (Like I was so stupid that I didn't know this?) the numbers would simply not reflect the negative comment. THIS IS HOW THEY KEEP THEIR NUMBERS SO HIGH, NOT WITH SATISFIED BUYERS! Sorry for the caps. He refunded my money then continued to badger me to withdraw my comment. When he realized that I was not going to, he transferred me over to a young woman, perhaps because he felt that there was some type of language barrier. She also continued to badger me about withdrawing it, and again I refused. I was getting really tired of being pressured in this manner and eventually I did withdraw it after I was also promised a further refund of $22 to make my total refund $50 and overnight shipping. The first refund of my shipping costs went through fine to my Paypal account, even though I did not pay for the item through Paypal. The second went through, however immediately after it was refunded, this company opened up a dispute on it. I eventually had to REFUND BACK MY OWN REFUND! Additionally, I did not receive overnight shipping on this item, it came 4 days later as standard ground shipping. So, bottom line with this seller is this. They promise you one thing after pressuring you, the fail to live up to their promises. When you try to resolve the issue, they ignore you, lie to you, and say there is nothing they can do. I have reported them to Ebay and asked that my negative rating be added back, but it cannot be. Ebay also says that there is nothing they can do about this. I have demanded a full refund as a 'good faith' gesture to make up for all the long distance phone calls I have had to make, my time and frustration with their dishonesty and the time I have had to spend trying to get a resolution to this. Is this common with them? Who knows, but it was a nightmare for me. I truly feel that the only way they can keep their percentage up is by what they did with me.[/quote] |

If they shipped it to an address that you didn't want it sent to and that has resulted in the product being non-functional, then that's their fault.
Don't bother trying to dry it out and turn it on, just get it replaced or get a refund. |
