yeah i theorised it may have been the battery
however, although there is some slight allowance for the battery to move, the point of contact moves with it as to ensure that it doesn't lose contact
since it's only a few days old i'm gonna stick it out for another week, see if these mytery issues magically disappear... if not it's on the phone to iriver!
